O R D E R

% 16.05.2025 W.P.(C) 6608/2025 1.

The present writ petition has been filed seeking directions for quashing the letters dated 19th September, 2024, and 06th November, 2024, issued by respondent no. 2 i.e. Delhi Jal Board ('DJB'), whereby, the DJB has demanded the Sanctioned Building Plan of the building, i.e., property bearing no. M-167, First Floor, Greater Kailash-II, New Delhi 110048. 2.

Learned counsel appearing for the petitioner submits that the petitioner has purchased the first floor of the aforesaid property vide Sale Deed dated 04th July, 2024. It is submitted that the petitioner, in order to get The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

the water connection, filed an application before the respondent no. 2. However, respondent no. 2, i.e., DJB, vide letter dated 19th September, 2024, has demanded a sanctioned Building Plan of the said property, which was constructed in the year 1984.

Learned counsel appearing for the petitioner further submits that the petitioner has purchased the first floor of the property in question only in July 2024, and does not have the sanction Building Plan of the said property, which is an old constructed property. He further submits that water connections are existing in the property in question, for the other flat owners.

Notice is accepted by learned counsels appearing for respondent nos. 1 and 2/ DJB.

Learned counsel appearing for the respondent no.2/DJB, on instructions, submits that DJB shall not insist upon any Building Plan to be submitted by the petitioner. However, she submits that the DJB shall be satisfied, in case, the petitioner gives an undertaking that no redevelopment or reconstruction is taking place, in the building in question. 7.

In response, learned counsel appearing for the petitioner, on instructions, submits that the petitioner shall give an undertaking in this regard.

Accordingly, it is directed that, upon the petitioner submitting an undertaking to the DJB that no redevelopment/ reconstruction is taking place in the property in question, the DJB shall forthwith proceed to grant water connection on the property bearing no. M-167, First Floor (Rear Portion), Greater Kailash-II, New Delhi 110048.

It is directed that the DJB shall not demand any Sanctioned Building Plan of the building in question from the petitioner. 10.

However, the petitioner shall fulfil all the formalities, which are required to be fulfilled for the grant of a new water connection by the DJB, at the premises in question.

With the aforesaid directions, the present petition, along with the pending application, is disposed of.
