Petitioner impugns order dated 24.08.2017 whereby leave to defend application of the petitioner was dismissed and an eviction order passed.

Petitioner further impugns order dated 10.07.2019 whereby review application of the petitioner was also dismissed. 3.

Parties have settled their disputes. Possession of the tenanted premises has already been surrendered through execution of the warrants of possession.

Learned counsel for the petitioner under instructions from the petitioner who is present in court in person submits that he does not RC.REV. 440/2019

wish to press the present petition and seeks to withdraw the same. 5.

In view of the above, the application seeking withdrawal of the petition is allowed.

The petition is dismissed as withdrawn.
