The present application under Section 439 Cr.P.C has been filed by the Petitioner for grant of regular bail in FIR No.1161/2023 dated 02.09.2023, registered at Police Station Nihal Vihar for offences punishable under Sections 376D/323/34 of IPC.

The facts of the case reveal that the proceedings arise out the matrimonial dispute. The Petitioner is the husband of the complainant. FIR No.1161/2023 dated 02.09.2023 has been registered at Police Station Nihal Vihar for offences punishable under Sections 376D/323/34 of IPC. The Petitioner/husband is in custody since 28.09.2023. 3.
In the matrimonial proceedings, with the help of Counselling Cell, Family Court, Tis Hazari Court, Delhi, a settlement has been arrived at between the parties. The Settlement Agreement dated 18.03.2024 reads as under:

Since the parties have entered into an amicable settlement in the matrimonial dispute and the FIR that has been filed by the wife/complainant, this Court is of the opinion that no useful purpose would be served in keeping the Petitioner in custody.

The Petitioner is enlarged on regular bail subject to his furnishing a personal bond in the sum of Rs.50,000/- with two sureties of the like amount to the satisfaction of the Trial Court/CMM/Duty Magistrate. 7.
The application is disposed of.
