% 04.03.2025 I.A.5747/2025 and I.A. 5749/2025 (for recording of settlement) 1.

Both the aforesaid applications are joint applications filed on behalf of the plaintiff and the defendants no.1 and 2 respectively for recording terms of compromise.

I.A. 5747/2025 has been filed for recording of the settlement between the plaintiff and the defendant no.2.

3.

The terms of settlement are given in paragraph 3 of the aforesaid application.

4.

I have gone through the terms of the settlement and find the same to be lawful.

5.

Parties shall remain bound by the terms of the settlement. 6.

been received from the defendant no.2.

I.A. 5749/2025 has been filed for recording of the settlement between the plaintiff and defendant no.1.

The terms of the settlement are given in paragraph 4 of the aforesaid application.

I have gone through the terms of the settlement and find the same to be lawful.

Parties shall remain bound by the terms of the settlement agreement. 11.

In view of the above, both the applications are allowed. CS(COMM) 538/2023 12.

In view of the order passed above in I.A. 5747/2025 and I.A. 5749/2025, the suit is decreed in favour of the plaintiff and against defendants no.1 and 2. The aforesaid applications shall form part of the decree.

Decree sheet be drawn up accordingly.

In view of the fact that the matter has been settled at initial stage, the Registry is directed to issue a certificate of refund of 50% of the Court Fees in favour of the plaintiff, in terms of Section 16A of the Court Fees Act, 1870.
