O R D E R

% 02.01.2017 The petitioners have filed the present petition seeking quashing of FIR No.45/2015 registered on the complaint of the complainant under Sections 420/468/471/34 34 IPC against the petitioners at Police Station Sabzi Mandi The complainants and respondent no.4 are present in Court. They are identified by the Investigating Officer.

The allegations against the petitioner and respondent no.4 are that they had misrepresented to the complainants that they shall get their child admitted to Delhi University for which they had taken Rs.2.10 lacs from the complainants.

The petition is premised on a settlement on the ground that the said money has now been returned to the complainants. The complainants state that in view of the settlement reached, they do not wish to pursue the complaint and joins the prayer for quashing of the FIR in question. However, looking to the seriousness of the allegations which suggest that the petitioner may be involved in a racket with regard to such illegal admissions being made in Delhi University, the court was not inclined to initially quash the FIR.

Learned counsel for the petitioner, on instructions, states that they are willing to be subjected to such costs as this court may deem appropriate in the facts and circumstances of the case.

In view of the aforesaid, no useful purpose would be served in proceeding further with the FIR in question and the proceedings emanating therefrom. The same are hereby quashed subject to deposit of costs of Rs.One Lakh with Prime Minister's National Relief Fund within four weeks by the petitioner. Receipt of cost be deposited with the IO and whereafter the case shall be closed.
