Appellant is aggrieved by order whereby application moved under Order XXXIX Rule 1 and 2 of CPC read with Section 151 CPC filed by respondent (plaintiff before the learned Trial Court) has been allowed. 2.

By virtue of the aforesaid order, the appellant (defendant before the learned Trial Court) has been restrained not to create any third party interest in the subject property till the disposal of the suit. 3.

None appears from the side of appellant.

It is noticed that even on the last date of hearing, there was no appearance from the side of appellant. It seems that the appellant has lost interest in pursuing with the present appeal. 5.

The appeal is, accordingly, dismissed-in-default and for non prosecution.
