Petition under Section 482 of the Code of Criminal Procedure, 1973 („Cr.P.C.‟) read with Article 227 of the Constitution of India has been preferred on behalf of the petitioner with the following prayer: "Issue appropriate directions / orders for expeditious filing of Charge-Sheet in FIR No. no 459/ 2018, Ps Samay Pur Badli, in the case titled as: State Vs Jasmer & Ors. u/s 408/34 Indian Penal Code."

Learned counsel for the petitioner submits that present petition has been preferred on behalf of the petitioner (complainant), since despite registration of FIR bearing No. 0459/2018 under Sections 408/34 IPC on 02.06.2018, investigation has neither been concluded nor final report/charge-sheet has been filed till date. 4.
On the other hand, learned APP for the State, upon instructions from IO/Insp. Rajesh Kumar, P.S. DIU, submits that it appears that final report could not be filed on account of non-cooperation by the complainant. She further informs that a notice has been issued to the complainant to join the investigation for concluding the same expeditiously and the final report shall be filed within 90 days.

Taking the statement of learned APP for the State on record, petition is accordingly disposed of. An endeavour shall be made to file the final report within a period of 90 days from passing of this order, unless the investigation is required to be continued for some exceptional reasons. Pending applications, if any, also stands disposed of.
