O R D E R

The present bail application has been filed seeking anticipatory bail in FIR No. 6/2019 under Section 3 of the Railway Property (Unlawful Possession) Act, 1966 registered at Police Station Railway Police Force, Adarsh Nagar, Delhi.

Learned counsel for the petitioner submits that all the accused have joined investigation on more than 15 occasions. He further submits that the case property has been seized from one of the accused namely, Naushad and they have been released on regular bail.

Learned APP for the State as well as learned counsel for respondent No.2 have vehemently opposed the bail application. BAIL APPLN. 1797/2019

In view of the facts and circumstances of the case and the fact that the petitioner has joined investigation and the case property has been seized, it is directed that in the event of arrest, the petitioner be released on bail, subject to his furnishing a personal bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the concerned I.O./S.H.O. and subject to the following conditions :- (i) The petitioner shall join investigation as and when he is asked to do so.

(ii) The petitioner shall not directly or indirectly make any inducement, threat or promises to the complainant or any witness during the trial or tamper with the evidence. (iii) The petitioner shall provide the I.O./S.H.O. Police Station Railway Police Force, Adarsh Nagar, Delhi with his mobile number and in the event of change of his residential address, shall inform the same to the concerned I.O./SHO as well as to the concerned Court.

With the above directions, the application is disposed of. 6.
