% 14.03.2017 By the present petition, the petitioner seeks regular bail in case FIR No.946/2016 under Section 376 IPC registered at PS New Usmanpur. The prosecutrix in the FIR alleged that for the last 6-7 months she was residing on rent and became acquainted to the petitioner who gave her a mobile phone and SIM card where after they started talking to each other. The petitioner made forcible relationship with her, though she refused but he did not mend his ways. On 12th November, 2016 the petitioner in a heavily drunken condition physically assaulted her. He used to pay her expenses as well but for the last two months he stopped bearing her expenses. Later when she was pregnant, she asked the petitioner to marry her to which he refused. The petitioner has been in custody since 17th December, 2016. Statement of the prosecutrix was recorded under Section 164 Cr.P.C. wherein she stated that in a fit of anger she lodged the FIR. BAIL APPLN. 201/2017
Be that as it may, in the contents of FIR disclose commission of offence punishable under Section 376 IPC and the prosecutrix is yet to be examined before the learned Trial Court. Thus this Court finds no reason to grant bail at this stage.
Petition is dismissed.
