O R D E R

% 03.02.2017 Learned counsel for the petitioner submits that as per the FIR, Dheeraj was the driver of the complainant. The truck driven by Dheeraj was loaded from TPG wholesale, Ghevra, Delhi. The goods were to be transported to Nangloi. However, Dheeraj did not deliver the goods nor returned with the truck.

It is submitted that FIR was registered under Section 407 IPC. Charge-sheet has also been filed under Section 407 IPC against Jitender @ Dheeraj. Petitioner has not been named in the FIR. Petitioner was neither employed by the complainant nor was entrusted any goods. Learned APP for the State submits that petitioner has been named in the disclosure statement of Dheeraj. He further submits that petitioner was also part of the conspiracy. Petitioner also belongs to the same village as

Dheeraj. Custodial interrogation is required. In the facts and circumstances of the case, it is ordered that in case of arrest petitioner be released on bail subject to furnishing a personal bond in the sum of `25,000/- with one surety in the like amount to the satisfaction of Arresting Officer/Investigating Officer/SHO of the concerned police station. Bail application is disposed of in the above terms. Miscellaneous applications are disposed of as infructuous.
