O R D E R

% 06.12.2019 CM APPL No.52590/2019 is moved for release of payment in terms of the settlement so arrived at between the parties before the Mediation Centre, Delhi High Court, New Delhi per settlement agreement dated 19.11.2019.

The terms of the settlement have been enumerated in para No.6(a) to 6(f) of the settlement agreement dated 19.11.2019. It is stated that settlement has been arrived at without any undue influence from any corner and settlement is legal.

In view of the settlement so arrived at between the parties, the appeal stands disposed of in terms of para No.6(a) to 6(f) of the settlement agreement dated 19.11.2019. The parties shall be bound by such settlement.

It is settled between the parties and ordered that out of amount of Rs.57,08,582/- deposited by the appellant, an amount of Rs.45,52,052/- shall be released to the respondent and balance amount

along with accrued interest thereupon shall be released in favour of the appellant. The pending application, if any, also stands disposed of. The appellant shall be entitled to the refund of the court fees as per Court Fee Act.

The application stands disposed of in above terms. The date already fixed 18.12.2019 stands cancelled. YOGESH KHANNA, J.
