Petitioner is defending a suit which is summary in nature and is aggrieved by order dated 05.03.2025 whereby conditional leave has been granted to him on depositing half of suit amount.

Learned counsel for respondent appears on advance notice and submits that the present petition has become infructuous as the learned Trial Court has already decreed the suit on 30.04.2025 as the aforesaid condition has not been complied with by the defendant.

subsequent development. He submits that he would challenge the aforesaid judgement and while challenging the aforesaid judgment, he would also impugn the order dated 05.03.2025 which is challenged herein. 4.
In view of the above, present petition is disposed of as having become infructuous. Petitioner is always at liberty to challenge the aforesaid judgment and decree and while impugning the same, it is at liberty to challenge order dated 05.03.2025 also.
