W.P.(C) 1024/2017 The present petition has been filed by the petitioners challenging the order dated March 17, 2016 of the Revenue Assistant / SDM, Kapashera. Learned counsel for the petitioners concedes to the fact that the remedy for the petitioners against the impugned order is before the concerned Deputy Commissioner. He fairly states that in view of the remedy being available to the petitioners before the Deputy Commissioner, appropriate Appeal shall be filed along with applications seeking condonation of delay, if any, and for other reliefs within two weeks from today.

It is made clear that the petitioner shall be entitled to raise all grounds on facts and in law including the maintainability of the proceedings under

section 86A, in their appeal before the concerned Deputy Commissioner. The petition is disposed of with liberty on the above terms, to the petitioner to approach to the Deputy Commissioner within two weeks. CM. No. 4682/2017 (for stay) Dismissed as infructuous.
