Mr. B. K. Sood, learned counsel for the petitioner submits that the case of the petitioner is similar to the case of the petitioner in W. P. (C) 3912/1991.

It is submitted by him that the aforesaid writ petition was with respect to the Okhla Flatted Factories Associations, whereas, the instant case relates to Jhandewalan Flatted Factories Association. attention of the Court to Order dated 01.06.2006 (Annexure R-J-2 of the petition) and points out that by the said order and in compliance of the Court directions, the scheme for conversion from rental lease to hire purchase has been approved by the respondent-Government of NCT of Delhi subject to certain terms and conditions.

Learned counsel who appears for respondent no.3- Delhi State Industrial and Infrastructure Development Corporation ('DSIIDC'), submits that the said respondent is under active consideration of the petitioner's request. However, on account of non-receiving of the response from Public Works Department ('PWD'), the matter could not be taken to its logical conclusion.

The Court has considered the facts and circumstances of the entire controversy and finds out that with respect to various other associations and areas, almost similar directions were granted. Let the DSIIDC to bestow its thoughtful consideration to the grievance of the petitioners and to pass appropriate order keeping in mind the directions already passed by this Court vide Order dated 12.05.2005 passed in W. P. (C) 3912/1991. However, if the DSIIDC is of the opinion that the PWD needs to be consulted, let the necessary consultation to take place. Let the PWD to fully cooperate with the DSIIDC in deciding the pending isuse. 5.

Let the final decision be taken by the respondent no.3- DSIIDC, within a period of four weeks from the date of receiving a copy of the order passed today.

With the aforesaid directions, the petition, along with pending application, stands disposed of.
