O R D E R

The present petition raises a grievance as regards unauthorized construction at property bearing No.846, 843-B, Khasra No.242/244, Gali No.22, Zakir Nagar, Jamia Nagar, New Delhi-110025. 2.

Learned counsel for the MCD, who appears on advance notice, submits that the property in question has been identified and co-related with the photographs filed along with the present petition. It is submitted that the property in question is found to be located between the properties bearing Nos.850/22, Zakir Nagar and 244/22, Zakir Nagar. 3.

It is further submitted that the property in question has already been booked for unauthorized construction and a demolition order has already been passed inasmuch as the entire construction has been found to be without any sanction plan.

It is stated by learned counsel for the MCD, on instructions, that appropriate action for demolition of the property in question shall be taken expeditiously, in accordance with law and in any event, within a period of eight (08) weeks from today. The said statement is taken on record. 5.

In view of the aforesaid, learned counsel for the petitioner does not wish to press the present petition at this stage; the same is accordingly dismissed as withdrawn, however, taking on record the aforesaid statement of the learned counsel for the MCD. The pending application also stands disposed of.

Needless to say, the same shall be subject to the statutory/appellate remedies of the owner(s)/occupier(s) of the property in question. 7.

In case there is any deficiency in the action taken by the MCD, the petitioner shall be entitled to avail appropriate remedy in accordance with law.
