The present Petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 has been filed on behalf of petitioner seeking grant of parole for a period of eight weeks for taking care of his wife, who requires immediate treatment and hospitalization.

It is submitted in the petition that earlier also the sentence of the petition was suspended vide Order dated 03.08.2021for a period of four weeks on account of precarious health condition of his wife, and the same has been extended from time to time.

Therefore, the prayer is made that the petitioner may be released on parole for a period of eight weeks to take care and attend to his wife. 4.

that no application for grant of parole has been moved by the petitioner before the Jail Authority. Therefore, the present petition seeking parole is premature.

In view of the submission made, the present petition is disposed of with liberty to the petitioner to move appropriate application for parole before the concerned Jail Superintendent who shall decide the same within four weeks.

Needless to state that if the petitioner is aggrieved by the Order of the concerned Jail Superintendent, he is at liberty to approach this Court.
