The respondent has filed his application for release of the decretal amount of Rs.3,20,000/- deposited by the appellant with the Registrar General of this Court in compliance of order dated 09th December, 2013. The appellant is further seeking release of Rs.4,03,000/- deposited by the appellant before first Appellate Court in RCA No.5/2011. 2.

There is no appearance on behalf of the appellant. No one appeared even yesterday i.e. 06th October, 2016.

RSA No.45/2013 was dismissed by this Court on 05th May, 2016. In that view of the matter, respondent is entitled to release of the amount prayed for.

The application is allowed and the Registrar General is directed to release the amount deposited by the appellant along with the interest accrued thereon to the respondent. First Appellate Court i.e. Court of Dr. Neera Bharihoke, ADJ-01, South District, Saket Courts, New Delhi which decided RCA No.5/2011 on 31st January, 2013, is also directed to release the amount

deposited by the appellant along with interest accrued thereon to the respondent.

Copy of this order be given dasti to learned counsel for the respondent under signature of Court Master.
