The present applications have been filed for the grant of anticipatory bail in case F.I.R. No.0594 dated 19.08.2023 registered under Section 323/354 of IPC at PS Jyoti Nagar.

Admittedly, now the chargesheet has been filed without any arrest by the prosecution.

Learned counsel for the petitioners submits that the learned trial court despite the chargesheet having been filed without any arrest, has issued nonbailable warrants against the petitioners. Learned counsels for the petitioners submit that all the applications have arisen out of the same FIR bearing no. 0594/2023.

In the present case, since the chargesheet has been filed without any arrest of the petitioners, accordingly, the petitioners are permitted to be released in the event of their arrest on their furnishing a personal bond in the sum of 20,000/- each with one surety of the like amount each to the satisfaction of the Trial Court/IO/SHO, subject to the following conditions: a) the Petitioners shall appear as and when directed by the Investigating Officer/court concerned;
b) the Petitioners shall under no circumstances leave India without prior permission of the Court concerned;
c) the Petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case; d) the Petitioners shall provide their mobile number to the Investigating Officer and keep it operational at all times; and e) In case of change of residential addresses and/or mobile numbers, the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
Petitioners shall intimate the same to the Investigating Officer/ Court concerned by way of an affidavit.

It is made clear that the expression of any opinion hereinabove may not be treated as an expression on the merits of the case. 6.

Copy of the order be sent to the concerned Jail Superintendent for information and necessary action.
