versus STATE ..... Respondent Through:

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 26.09.2019 1.

The petitioner has filed the present petition, inter alia, praying that verification of sureties and other verifications, required for release of the petitioner on furlough, be done at the earliest. 2.

The said prayer does not survive, as the petitioner was released on furlough subsequently. However, the petitioner has also pointed out that in this case, it has taken the concerned authority more than four months to verify the surety.

3.

He submits that this delay is inordinate and steps should be taken to streamline the process so that sureties are verified expeditiously. He also relies on a decision of the Division Bench of this Court in Court on its Own Motion v. State of NCT of Delhi: W.P.(CRL) 1779/2014, decided on 25.03.2015.

4.

Clearly, the petitioner's contention that there has been an inordinate delay in verifying the surety in this case is merited. The concerned DG, Prisons and the Commissioner of Police are directed to examine the delay that has occurred in this case and take such remedial measures as are necessary.

5.

The petition is disposed of with the aforesaid observations. VIBHU BAKHRU, J SEPTEMBER 26, 2019 RK
