The petitioner has filed the present review petition under Section 115 of Code of Civil Procedure, 1908 assailing the impugned order dated 12.04.2024 passed by learned Presiding Officer, (Central) Tis Hazari Court, Delhi, whereby the suit of the petitioner/plaintiff has been held to be not maintainable and thereby dismissed under Order 11 Rule 1(d) CPC.

None is present for the respondent despite sending advance notice.

After some arguments, learned counsel for the petitioner requests permission to withdraw the present petition with liberty to file appropriate proceedings against the respondent. The same is dismissed as withdrawn with liberty to file appropriate proceedings as per law.
