% 17.03.2017 The petitioner seeks liberty to withdraw the writ petition to file an appeal against the final orders of the Central Excise & Service Tax Appellate Tribunal.

The averments and the documents produced by the petitioner show that apparently an appeal was filed in 2012 but returned due to objections after which it was not re-filed. The petitioner submits that the counsel engaged at that time did not re-file the appeal and that it became aware of these circumstances only much later. In the circumstances, liberty sought is granted. The writ petition alongwith pending applications is dismissed as withdrawn. S. RAVINDRA BHAT, J.
