Appeal under Section 378 of the Code of Criminal Procedure, 1973 has been filed on behalf of the Petitioner/State against acquittal of the Respondent for the offences punishable under Section 279/304A of the Indian Penal Code, 1860 vide impugned Judgment dated 28.02.2020, passed by the learned Metropolitan Magistrate (North), Rohini Courts, New Delhi in Case FIR No. 388/2011 under Section 279/304A of the IPC registered at Police Station Shahbad Dairy. 2.

Learned APP for the State, submits that the Respondent, namely, Mr. Ramesh Kumar has died on 14.06.2023. The Death Certificate of the Respondent showing his death on 14.06.2023, has been confirmed.

In view of the submissions made, the Appeal stands abated and disposed of accordingly.
