Learned counsel appearing on behalf of the petitioner submits that during the pendency of the instant petition, the order passed by the authority concerned has already been implemented, hence no substantive relief can be claimed at this stage. Learned counsel for the respondents also affirms that the impugned order stands complied with.

The petitioner, however, submits that since the cost of Rs.1 lakh has been imposed upon the South Delhi Municipal Corporation (SDMC) which has been directed to be recovered from the salary of the concerned officers in due course of time, the petitioner-SDMC as of now, is only aggrieved by the aforesaid directions. Learned counsel further submits that the facts of the case are such which resulted in creating the controversy in question. He submits that none of the officers deliberately attempted to cause any inconvenience to any of the parties.

Learned counsel appearing on behalf of the respondents does not oppose the submission with respect to setting aside the direction for imposition of cost.

In view of the aforesaid, the directions contained in paragraph no.22 in order dated 09.08.2021 with respect to the imposition of cost of Rs.1 lakh stands set aside.

It be also placed on record that the property in question has already been regularised as stated by learned counsel appearing for the parties. 6.
Accordingly, the instant petition along with pending application stands disposed of.
