% 17.05.2018 On 9th March, 2018, it was recorded that the Respondent had closed its business and the owner of the company could not be traced. Learned counsel for the Appellant sought time to seek instructions to take steps to find the fresh address of the Respondent. Last opportunity was given to the Appellant to take steps for service.

On 5th April, 2018, learned counsel for the Appellant did not appear and an authorized signatory had appeared. No steps have been taken. Even process fee has not been filed. Despite the same, the matter was adjourned directing the Appellant to ensure compliance of the order dated 9th March, 2018.

Today none appears for the Appellant and no steps also appear to have been taken. The Registry's report is that process fee has not been filed. In these circumstances, the appeal is dismissed for non-prosecution. PRATHIBA M. SINGH, J.
