O R D E R

Petitioner herein seeks quashing of an FIR No. 295/2023 dated 10.07.2023 for the offences under Sections 498A, 406, 34 IPC, registered at Police Station Malviya Nagar, along with consequential proceedings arising therefrom, on the basis of a compromise.

Dispute arose from matrimonial discord between petitioner no.1 (husband) and complainant/ respondent no.2 (wife). The couple got married on 21.02.2019 according to Hindu rites and no child is born from the wedlock.

It transpires that during the pendency of the present petition, a Transfer Petition (Civil) No. 930/2025 was filed before the Supreme Court, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

wherein the dispute was amicably resolved with the intervention of their respective learned counsel. The said transfer petition was accordingly disposed of vide an order dated 29.04.2025.

The aforesaid order dated 29.04.2025 is reproduced herein below for ease of reference:- "1.

It is heartening to note that with the intervention of respective learned counsel, the parties have amicably resolved their disputes. I.A. No.97077 of 2025 has been jointly filed by the parties seeking appropriate directions under Article 142 of the Constitution of India for dissolving their marriage as per the terms of the Settlement Agreement dated 09.02.2025, a copy whereof is filed as Annexure-P-1 (Page No.9 of the application seeking permission to place on record the additional facts and documents).

Learned counsel for the parties have submitted that all the disputes and differences between the parties have been amicably resolved, and the parties have decided to part ways on certain terms and conditions. Accordingly, appropriate and necessary orders may be passed in accordance therewith.

It is not in dispute that the entire amount as per the Settlement Agreement stands paid by the respondent to the petitioner. 4.

It is further agreed between the parties, as per paragraph no.6 of the Joint Application, the cases mentioned therein, as described below, shall stand closed:

"ii. Quash and/or dispose of the Maintenance Petition (Maintenance Petition No. 374 of 2021) titled as Priya Mishra vs Raghav Pandey, pending adjudication before Sh. Pritam Singh, Family Court No. 1, South District, Saket Court Complex, New Delhi;

iii. Quash and/or dispose of the Complaint under the Protection of Women from Domestic Violence Act, 2005. (CC Case No. 1134 of 2021), titled as Priya Mishra vs Raghav Pandey & Ors., pending adjudication before the Court of Ms. Sana Khan, MM03 (Mahila Court), South District, Saket Courts Complex, New Delhi) iv. Quash the criminal proceedings arising out of the FIR No. 295 of 2023 dated 10.07.2023 u/s 498A, 406 r/w 34 of the Indian Penal Code at Police Station Malviya Nagar, New Delhi lodged by the Petitioner against the Respondent herein, Mr. Rajeev Pandey (Father of the Respondent) and Mrs. Padma Pandey (Mother of the Respondent)."

In view of the above, the following directions are issued: The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

i) The marriage solemnized on 21.02.2019 between the petitionerPriya Mishra, and the respondent-Raghav Pandey, is hereby dissolved by a decree of divorce by mutual consent. ii) All the legal proceedings pending inter se the parties, as indicated above, shall stand closed.

iii) Decree be drawn up accordingly.

iv) It goes without saying that both parties will continue to abide by the terms of the Settlement Agreement without any exception. v) Registry is directed to forward a copy of this order to the foras/courts concerned for passing formal orders closing the cases. vi) The Settlement Agreement dated 9th February 2025 shall form part and parcel of this order.

We record our appreciation for the reasonable stand taken by the parties, as well as the cooperation extended by their respective counsel.

In view of the above facts, I.A. No.97077 of 2025 and the Transfer Petition is allowed.

Pending application(s), if any, shall stand disposed of." 5.

In view of the aforesaid, the present petition thus deserves to be allowed. Accordingly, the FIR No.295/2023 dated 10.07.2023 for the offences under Sections 498A, 406, 34 IPC, registered at Police Station Malviya Nagar, and all other proceedings arising therefrom, are hereby quashed.
