1. The present petition under Article 226 & 227 of the Constitution of India seeks to assail the order dated 28.05.2018 passed by the learned Central Administrative Tribunal (Tribunal) in Original Application (O.A.) No. 3435/2016.
Vide the impugned order, the learned Tribunal has allowed the O.A. filed by the respondent/applicant and has consequently, directed the petitioners to reimburse the medical claim of the respondent in respect of medical treatment of his son for Cochlear Implant Surgery.
2. The record shows that despite the matter having remained pending before this Court for the last almost two years, notice is yet to be issued in the petition. Upon query by us, learned counsel for the petitioners fairly submits that the impugned order has been implemented and the respondent has been reimbursed the amount claimed by him.
The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 17/12/2024 at 15:45:08
3. Once the impugned order itself has been implemented, we see no reason to entertain a challenge to the order passed almost six years ago or keep the present petition pending any further.
4. The writ petition is, accordingly, disposed of by making it clear that the directions issued in the impugned order will not be treated as a precedent having been passed in the peculiar facts and circumstances of the present case.
