Through the present Writ Petition, the Petitioner seeks following prayers :

"(a) Issue an appropriate writ including certiorari thereby quashing the orders dated 29.04.2019 and 29.11.2018 passed by Ld. Central Administrative Tribunal, Principal Bench, New Delhi in M.A.

321/2019 and M.A.

No.

263/2015.respectively of O.A. No. 996/2012 case titled as P N Sharma versus Ministry of Defence.

(b) Issue a direction to respondents for expunction of unwarranted and unsubstantiated adverse noting/remarks reported in ACRs pertaining to year 2002-2003 and 2003-2004 of petitioner respectively.

(c) Issue a direction to the respondents for ensuring all the entitlements which were denied on account of said adverse noting in the ACRs of the petitioner including the legitimate due promotion of the petitioner considering antedated eligibility with all notional benefits.

(d) Pass any other order or direction as this Hon'ble Court may deem fit under the circumstances in interest of justice." 2.

being O.A. 996/2012 before the learned Central Administrative Tribunal, challenging the correctness of adverse entries pertaining to the years 2002-2003 and 2003-2004.

The Petitioner, who has died in the year 2021, did not prosecute the O.A. properly, resulting in its dismissal on 29.11.2018. He filed a miscellaneous application in the year 2019 being M.A. 321/2019. At that stage, the learned Tribunal considered the case of the Petitioner on merits and found that the Petitioner has failed to furnish sufficient explanation for condoning the delay in filing the O.A. Hence, the M.A. was also dismissed on 29.04.2019.

Thereafter, the Petitioner filed the present Writ Petition. It is pertinent to note that the Petitioner's representation against the adverse entries was rejected way back on 04.01.2006. Undisputedly, the Petitioner filed various O.A.s in between seeking different reliefs, however, no ground has been averred by the Petitioner to justify a delay of nearly six years in preferring the O.A. especially when his representation against the adverse entries, as noted above, was rejected on 04.01.2006.

Keeping in view the aforesaid position, no ground for interference by this Court in exercise of writ jurisdiction is made out. 6.
