Learned counsel for appellant on instructions seeks permission to withdraw this appeal since parties have compromised the disputes before the executing court on 04.10.2024, whereby the present appellant has undertaken to vacate the subject property on 25.11.2024 and to pay rent at the rate of Rs.30,000/- per month for the period from May 2023 to the date of vacation of the suit property. Learned counsel for respondent affirms the said settlement and informs that the post dated cheques for rent have already been delivered.

As requested, the appeal is dismissed as withdrawn.
