The petitioner has filed the present petition, inter alia, impugning the order dated 10.06.2019 passed by the respondent, rejecting the petitioner's request for grant of parole. The order indicates that the petitioner's request was rejected in view of Sub-Rule (II) of Rule 1210 of Delhi Prison Rules, 2018 which provides that parole would not be granted to the convict within a period of two years after suffering major punishment. 2.

The nominal roll has been filed and the petitioner was awarded a major punishment on 26.02.2018 as a mobile phone with a battery, charger and a SIM card were recovered from his possession. The petitioner is present in Court and states that no such recovery was made from him and he was wrongly accused.

This Court does not consider it apposite to entertain this controversy at this stage. This Court also does not find any mitigating circumstances which could warrant interference by this Court. Although the petitioner's mother is 64 years old, the Status Report indicates that she is drawing pension from the Government after the death of her husband, who was a Lab Assistant with a Government School. It is further stated that the petitioner has a younger brother aged 29 years.
