The present petition has been filed seeking quashing of FIR No.40/2021 registered under Sections 323/341IPC at P.S. Chandni Mahal, Delhi.

As per the allegation levelled in the FIR, the petitioner obstructed the path of respondent No.2 and gave beatings to him as a result of which, injuries were sustained.

The petitioner claims to be the father-in-law of respondent No.2. Learned counsel for the petitioner contends that the present FIR was lodged by respondent No.2 only out of vendetta, as the petitioner had filed a complaint against respondent No.2 on which an FIR was registered, being FIR No.41/2021 registered under Sections 325/323/341/34IPC at P.S. Chandni Mahal, Delhi. A copy of which has also been placed on record. 4.
I have gone through the material placed on record including both the aforesaid FIRs, both of which relate to an incident that allegedly took place The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. on 19.02.2021 at 7:30 P.M. In the present case, the complainant was medically examined, MLC was also prepared and subsequently, the nature of injuries was opined to be simple. The chargesheet is stated to be filed and the charges have also been framed.

Considering the fact that the petitioner has filed cross FIR for the same incident and has not disputed his presence at the spot and the further fact that the complainant was medically examined, I find no ground for quashing of the FIR.
