Perusal of record shows that the present appeal was filed in the year 2007 and came up for hearing on 12.01.2007. Notice was issued to the respondents. On 05.02.2007, fresh notice was issued to the respondent no.2 for 02.03.2007. On 20.03.2007, the appeal was admitted and the matter was adjourned to 24.04.2007 for filing reply to the application for condonation of delay. On 12.09.2007, the application CM 477/2007 was disposed of with the direction to the appellant to deposit the amounts totalling 50% of the decretal amount and the execution was ordered to be not proceeded with. On 09.07.2010, the matter was listed for hearing and since nobody appeared on behalf of the appellant, the appeal was dismissed for nonappearance. y was issued to the respondents. On 07.10.2010, the said application was allowed and appeal was restored to its original number. The appeal was admitted and put up in the category of Regular Matters. On 18.07.2011, 19.07.2011 and 25.07.2011 nobody appeared on behalf of the appellant. Since nobody appeared on behalf of the appellant on 25.07.2011, the appeal was dismissed. On 23.08.2011, an application for restoration came up for hearing and its notice was issued to the respondents for 16.09.2011. On 16.09.2011, the said application was allowed and the appeal was restored to its original number. The appeal was admitted and ordered to be listed in the Regular List.
Thereafter, the appeal came up for hearing on 25.07.2017 when nobody appeared on behalf of the appellant.
On 01.08.2017, 11.08.2017, 16.08.2017, 18.08.2017 and 21.08.2017 nobody appeared on behalf of the appellant and the matter was adjourned for today. Today again nobody appeared on behalf of the appellant. It appears that the appellant is no more interested in pursuing the present appeal. Consequently, the present appeal is dismissed in default. imi P.S.
