% 23.08.2018 Admittedly, defendant no.2, the sole proprietor of defendant no.1-company had expired during the pendency of the present proceedings. Though, the plaintiff was made aware of the death of defendant no.2 on 18th September, 2017, yet no steps have been taken till date to bring the legal heirs of defendant no.2 on record. Today also learned counsel for plaintiff states that the plaintiff is not aware about the legal heirs of the defendant no.2. Consequently, the present suit is disposed of as having abated against the defendants.
