O R D E R

After arguments, this appeal is disposed of with the consent order that respondent will pay to the wife of the deceased appellant, and who is substituted as a legal heir of the appellant in these proceedings, a sum of Rs.50,000/- in full and final satisfaction of all claims of the appellant/plaintiff in the subject suit.

This amount be paid within four weeks from today.

The cheque in favour of the wife of the deceased appellant will be handed over to the counsel for the appellant by counsel for the respondent. Payment by the respondent in the name of the wife of the RFA No.272/2007

appellant is subject to the wife of the appellant filing in this Court attorney on behalf of other legal heirs of the deceased appellant that the wife of the appellant Smt. Lalita Handa can receive the said amount of Rs.50,000/-. 2.

It is clarified that copyright granted in favour of the respondent will continue but subject to the respondent furnishing the necessary accounts every year for publications which are made by the respondent with respect to the copyright which existed of the book "WATER WELL TECHNOLOGY BY O.P. HANDA" of the deceased appellant which is published by the respondent under the Copyright Agreement dated 31.10.1986.

It is therefore clarified that the Copyright Agreement dated 31.10.1986 stands and is not cancelled.

Appeal is accordingly disposed of in terms of aforesaid consent order.
