The present petition for transfer of case CT No. 40575/2024 under Section 223 BNS, titled as Amber Jaitely Vs. Sh. Iste Istekar and Ors, Police Station Tilak Marg has been instituted pursuant to the order passed by Registrar General of this Court dated 14th May, 2025 in light of request letter dated 09th May, 2025 sent by Sh. Ravi, Learned JMFC-07, Patiala House Courts, New Delhi. The petition is accompanied with the judicial file of the above case and also the order passed by the learned Principal District and Sessions Judge, Patiala House Courts, New Delhi The order dated 08th May, 2025 passed by the concerned Learned Principal District and Sessions Judge, reads as under:

Perused order dated 24.04.2025 of Sh.Ravi Ld. JMFC-07, PHC, NDD, as per which on the last date of hearing, an ATR was received from the concerned P.S. wherein it was stated that the present matter pertains to the jurisdiction of PS I.P.Estate. The Court dealing with the case pertaining to said jurisdiction is at Tis Hazari Courts, Delhi. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 01/07/2025 at 18:02:35

The power of Inter District Transfer of the cases is vested in the Hon'ble High Court of Delhi.

In view of above, let this file be placed before Ld. Registrar General, Hon'ble High Court of Delhi, New Delhi on 14.5.2025 for appropriate directions ....."

Record of the case which is sent to this Court is perused. 3.

Vide minutes dated 15th April, 2019 of the Hon'ble Administrative and General Supervision committee of this Court, resolved as under:- "The resolution dated 16.01.2017 of this Committee has been reconsidered. It has been resolved to substitute the word "reference" with "transfer petition" in the said resolution. Therefore, henceforth, the request received from District & Sessions Judges and Principal Judges, Family Courts for transfer of case from one District to another District, subordinate to the High Court and competent to try or dispose of the same, upon recusal or for any other reason, shall be placed by the Registry by way of transfer petition before the concerned Bench for appropriate consideration and orders." 4.

Since according to the ATR received from the Police Station Tilak Marg, the above captioned case CT No. 40575/2024 under Section 223 BNS titled Amber Jaitely Vs. Sh. Iste Istekar and Ors, pertains to Police Station I.P. Estate and the matters pertaining to Police Station I.P. Estate fall within the jurisdiction of Court housed at Tis Hazari Courts, Delhi, it would be appropriate to transfer this case to the concerned JMFC Court who deals with cases pertaining to Police Station I.P. Estate. Accordingly, this petition stands disposed of.

A copy of this order be sent to the concerned courts for necessary compliance.
