No one appears for the appellant. This matter is on the Regular Board of this Court since 22.10.2018.

The impugned judgment and decree is a money decree in favour of the respondent/plaintiff, and though the appellant was to deposit the decretal amount in this Court, since the same was not deposited, CM No.7778/2007 for stay of the impugned judgment was dismissed by a Division Bench of this Court vide order dated 19.9.2007. 2.

It is therefore clear that appellant is not interested in pursuing the appeal. The appeal is accordingly dismissed in default and for nonprosecution.

Let no application for recall/restoration of this order be entertained by the Registry of this Court unless costs of Rs.20,000/- are first deposited with the website www.bharatkeveer.gov.in .
