The present petition raises a grievance as regards the alleged illegal and unauthorized construction at property bearing No.85D, Pocket-K, Sheikh Sarai-2, New Delhi-110017.

Learned counsel for Special Task Force/DDA (respondent no.3) submits that the special task force has taken cognizance of the complaint of the petitioner and has written to the MCD stating that requisite action be taken with regard to the unauthorized construction, referred to by the petitioner.

that the property in question has been booked on 13.05.2024; a show cause notice is stated to have been issued to the owner/occupier of the property in question. He submits that further action in accordance with law including demolition of the unauthorized construction, if necessary, shall be taken expeditiously. The said statement is taken on record. 4.

Let the MCD take requisite action within a period of six weeks from today.

Needless to say, any action that may be taken by the MCD shall be subject to compliance with appropriate procedural formalities and also subject to the statutory/appellate remedies of the owner/occupier of the property in question.

With the aforesaid directions, the present petition, along with pending application/s, is disposed of.

Let a compliance affidavit be filed by the MCD within a period of eight weeks.
