Petitioner impugns order dated 12.02.2019 whereby leave to defend application of the petitioner has been dismissed and an eviction order passed.

Respondent had filed the subject eviction petition seeking eviction of the petitioner from one shop on the ground floor of the property bearing No. B-1740, Shastri Nagar, Delhi -110052, more particularly as shown in red colour in the site plan annexed to the eviction petition. 3.

Learned counsel for the petitioner submits that petitioner has already surrendered his tenancy and handed over the peaceful vacant possession of the tenanted premises to the respondent. He seeks leave to withdraw the petition.
