BAIL APPLN. 193/2017 Issue notice. Notice is accepted on behalf of the State. The anticipatory bail application of the co-accused Vineet has been dismissed by a separate order today. Learned counsel for the petitioner submits that so far as the present petitioner is concerned, he has no previous involvements.

The complainant has named the petitioner in the complaint/ FIR itself as the person who accompanied the co-accused. Learned counsel for the petitioner has submitted that it was the complainant who had attacked both the accused without any rhyme or reason. Prima facie, this story of the petitioner seems implausible for the reason that it is the co-accused who has a criminal history in the past and it is highly unlikely that anybody would get embroiled in dispute with such a person without any rhyme or reason.

The complainant recognises both the accused since they reside in the same area. Even though the petitioner may not be involved in other cases, his association with the co-accused Vineet and the defence taken by both of them prima facie show that they have acted in collusion. Dismissed.
