Criminal Writ Petition under Article 226 of Constitution of India read with Section 528 Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the "B.N.S.S.") has been filed for providing protection by Respondent No. 1.

It is submitted that Petitioner No. 2 had filed the Complaint before the SHO, Dabri on 08.01.2025. The Petitioner No. 2 filed subsequent Complaint on 14.01.2025 as Respondents had trespassed into the property of the Petitioners and assaulted their son and vandalized their home. FIR No. 80027416/2025 has already been registered in respect of this incident on 12.03.2025. The Petitioner No. 1 made another Complaint on 19.03.2025 to the Police.

A Civil Suit for Permanent Injunction has been filed by Petitioner No. 1 on 02.04.2025 against Respondent No. 2, which is pending trial before The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

It is asserted that on 07.04.2025, a few unknown persons threatened the Petitioners to withdraw their FIR. The Petitioner No. 2 made a formal Complaint to P.S. Dabri and to file objections on 08.04.2025. 5.
A Representation dated 09.04.2025 was again made by the Petitioner No. 2 to P.S. Dabri and higher Police Officials. The Petitioner No. 1 also filed a Case No. 1049/2025 before learned JMFC, Dwarka, for monitoring the FIR. 6.
It is asserted that Respondents are notorious criminal and the Petitioners are living in constant mental tension, agony and fear because of their association with anti-social elements. Hence, a prayer is made for being granted protection.

Learned Addl. Public Prosecutor, on instructions from I.O., submits that the Petitioners and Respondents have some dispute about the installation of a Mobile Tower. Not only is the FIR registered, but also a Civil Case has been filed by the Petitioners, in addition to a Petition before learned M.M. for monitoring of the FIR.

Essentially, it is an inter-se dispute between the parties. However, whatever directions are given by the Court, shall be duly complied with. 9.
Submissions heard and record perused.

From the entire narration of the events, it is evident that there are multiple litigations/disputes between the parties, for which, an FIR has already been registered and a Civil Suit has been filed. In case, the Petitioners have any threat perception, they are at liberty to approach the District Witness Protection Committee, who may make an assessment and give requisite directions as mandated in the circumstances.
