The present petition has been filed under Articles 226 and 227 of Constitution of India seeking following relief: a) Issue a writ, order or direction in the nature of mandamus directing the Respondent Nos. I and 2 to provide the mandatory benefits to the child of the Petitioner (Ms. Amitanjali Tiwari) as per the Guidelines of Admission of EWS/DG & CWSN Category Students in Private Unaided Recognised Schools of Delhi issued by the Government of NCT of Delhi, including but not limited to provision of books, writing material, stationery and uniform, free of any charges;

b) Issue such writ, order or direction m the nature of mandamus to Respondent Nos. I & 2 to ensure provision of the mandatory benefits for the entire course of education of the child of the Petitioner at the Respondent School;

Mr. Aayush Agarwala, the learned counsel for the petitioner submits that the grievance articulated in the present petition is that the child of the petitioner was admitted in the respondent no.1 school under the EWS/DG/CWSN category but the respondent no.1 school had not provided him with the uniform and books.

He submits that as per Rule 8 of the Right of Children to Free and Compulsory Education Rules, 2011 schools are under obligation to provide free books, school uniform and writing material to each and every students belonging to EWS/DG category.

He submits that non-issuance of books and uniform to the petitioner happened last year as well.

He submits that after serving an advance copy of present writ petition to the respondent no.1 school, the school has issued the books and uniform to the petitioner, therefore, the present petition has been rendered infructous. 6.

Mr. Dhruv Rohatgi, learned counsel for the respondent no.2/DoE apprise the Court that the DoE has issued an order dated 24.03.2025 directing all schools to comply with the provision of Rule 8 of the Right of Children to Free and Compulsory Education Rules, 2011 (in short 'Rules') and provide free books, uniform, writing materials to EWS/DG category children studying in the respective schools, without fail. 7.

In view of the above, the petition is dismissed as having become infructous.

However, the respondent no.1 is directed to comply with its obligation under Rule 8 of the Rules in a time bound manner in every academic session.
