% 19.09.2017 The present appeal pertains to year 2007.

It came up for hearing on 24.01.2007 and was admitted on that day. It came up for hearing on 03.08.2010 when nobody appeared for the appellant and the appeal was dismissed.

An application for restoration of appeal was filed which was allowed vide order dated 16.10.2012. On 14.01.2013 and 22.03.2013 nobody appeared for the appellant. On 21.05.2013, matter was adjourned on the request of the appellant. On 24.07.2013, the respondents were ordered to be served through publication of notice.

On 13.09.2013, 21.08.2017 and 23.08.2017 nobody appeared for the appellant.

On 28.08.2017, the matter was ordered to be remained on board.

On 29.08.2017, counsel for the appellant took adjournment on the ground that the arguing counsel was not available.

The matter was adjourned to 04.09.2017.

On 04.09.2017, nobody appeared for the appellant. Thereafter the matter

came up for hearing for today and today also nobody appeared on behalf of the appellant.

It is apparent from the record that the present appeal was shown at item no.1 in the regular list and part of the regular list continuously for several dates.

It appears that the appellant is not interested in pursuing the present appeal. Consequently, the appeal is dismissed in default. P.S.TEJI, J SEPTEMBER 19, 2017 dd
