After hearing arguments for some time, learned counsel for appellant, without prejudice to his rights and contentions, does not press the present appeal and submits that since as per order dated 24.04.2025, passed by the learned Trial Court, his suit has been directed to be returned under Order VII Rule 10 CPC, with further direction to present it before the appropriate Court having jurisdiction, he would take requisite steps and would file the suit before appropriate Court. 2.

He also submits that while re-filing such suit, he would also move an application under Section 14 of Limitation Act, 1980, seeking exclusion of time spent before this Court while pursuing the present appeal. 3.

The present appeal is accordingly disposed of as not pressed. 4.

The appellant is always at liberty to file suit in terms of directions contained in order dated 24.04.2025 and is also at liberty to move appropriate application under Section 14 of Limitation Act, 1980.
