+ BAIL APPLN. 200/2017 RAKESH KUMAR ..... Petitioner Through:
Mr. Ashok Kumar Mishra, Advocate versus THE STATE (G.N.C.T. OF DELHI) ..... Respondent Through:
Mr. Akshai Malik, APP for the State with Raj Kumar Khatara, ACP, Ambedkar Nagar, Insp. Ajai Pratap Singh, SHO Pul Prahlad Pur, IO/SI Mohd. Naim.
CORAM:
HON'BLE MR. JUSTICE R.K.GAUBA
O R D E R
% 25.05.2017 Further status report has been filed.
Heard.
The case diary has also been perused. This court does not approve of the manner in which the then Station House Officer (SHO) of Police Station Pul Prahlad Pur in the status report dated 06.04.2017 had not indicated the evidence that had come to light during investigation till that stage. The status report submitted today reveals that after the petitioner herein had brought the victim back to the house he being accompanied by some of his associates, he had explained to Kusum Devi, the mother of the victim that there had been a quarrel in which injuries were sustained. It is the investigation carried out thereafter which brought out the two eye witnesses they being, Vinod Sharma and Tushar, their version revealing the involvement of the petitioner as one of the assailants. BAIL APPLN. 200/2017
Having regard to the eye witnesses account which has been available all along, the offence committed being quite serious in that the victim continues to be in a position where he cannot even communicate, the injuries having been opined to be dangerous, there is no good ground to admit the petitioner on bail.
Dismissed.
It is hoped the supervisory police officers shall hereinafter exercise better control and ensure that reports submitted to the court present facts in their entirety rather than there being any endeavour at concealment. R.K.GAUBA, J.
