This writ petition is filed on behalf of the Petitioner under Article 226 of the Constitution of India seeking the following reliefs:- "a. In the nature of mandamus directing the respondent no. 1 and 2 to pay 50% of the amount of the petitioner as per the Mediation Settlement Agreement dated 03.02.2024 within a week;

b. To fix a date for opening of Locker so that contents may be distributed between the petitioner and his brother equally as per valuation; c. Direct the respondent no. 3 to transmit the 50% share and amount accordingly to the petitioner within a week." 2.

Mr. Rout, learned Standing Counsel appearing for PNB submits that in terms of the Settlement Agreement dated 03.02.2024, the monies lying in the Bank will be transferred to the respective accounts of the Petitioner and her brother in equal proportion on receipt of certified copy of the order of the Trial Court in CS SCJ 800/2023. the Bank has no objection to the Petitioner operating the bank locker of the mother along with her brother and date and time to do so may be fixed by this Court.

Ms. Takiar, learned counsel for the Petitioner submits that copy of the judgment of the Trial Court downloaded from the website will be furnished to the Bank within one week from today.

Accordingly, this writ petition is disposed of directing Respondent No. 1 to transfer the amounts lying in the Bank in favour of the Petitioner and her brother in equal proportion pursuant to the Settlement Agreement dated 03.02.2024, within two weeks from the date of receipt of copy of the judgment. It is also directed that Petitioner and her brother will be permitted to operate the bank locker of their mother late Smt. Sudarshan Chopra on 10.12.2025 at 02:00 P.M.
