By way of present petition filed under Section 482 Cr.P.C., the petitioner seeks quashing of the order dated 14.07.2023 passed in Cr. Appeal No.109/2023 arising out of proceedings under Section 138, NI Act. 2.

In the impugned order, the appellate court had directed to pay 20% of the compensation amount, however, in the present proceedings, the petitioner was directed to deposit Rs.6,00,000/- against the aforesaid directions of the appellate court. The petitioner failed to comply with the same.

Learned counsel for the petitioner, on instructions, seeks leave to withdraw the present petition.

Leave, as prayed for, is granted. The present petition is dismissed as withdrawn alongwith the pending application.
