This matter has been on the regular board for the last one month and has been called on few occasions. Despite the same, none appears for the Appellants.

Present appeal arises out of a suit for recovery which has been decreed in the following terms.

"From the totality of the findings on the above mentioned issues, it is held that the plaintiff is entitled for a sum of Rs.4,10,600/- and not for any interest till the date of filing of the suit. Consequently, it is held that the plaintiff is entitled for the decree as under:- I.

Decree for principal amount Rs.4,10,600/- II.

Interest till the date of filing of the suit Nil. III.

Proportionate costs of the suit IV.

The plaintiff shall further be entitled for pendent lite and future interest at the rate of 9% per annum from the date of filing of the suit till the realisation of the entire decreetal amount. "

On 10th April 2012, it was recorded that the Appellants had failed to

deposit the decretal amount and hence there was no stay of operation of the impugned judgment and decree.

Since none has appeared for Appellants, appeal is dismissed for nonprosecution. PRATHIBA M. SINGH, J.
