Writ Petition under Article 226 of Constitution of India read with Section 482 Cr.P.C. has been file for quashing of FIR No. 0467/2023 registered under Sections 308/34 IPC at P.S. Dwarka South in terms of the Settlement dated 18.05.2024 between the Petitioner and the Respondents No.2 and 3.

Learned Counsel on behalf of the State submits that this is a case of partial quashing. 05 Accused have joined the investigations after which, the Chargesheet against them has been filed in the Court. The present Petitioner did not join the investigations and thereafter, has entered into the Settlement with the Respondents No. 2 and 3. Accused, who has failed to join the investigations, is vehemently opposed. Submissions heard and record perused.

According to the Petitioner, he is not visible in the CCTV footage and therefore, the Respondents No. 2 and 3 have agreed to settle the matter, which is also endorsed by the Counsel for the Respondents No. 2 and 3. 4.
From the submissions made on behalf of the State, it is evident that the Petitioner, who fails to join the investigations and thereafter, tries to take advantage by entering into a compromise with the Complainant. This is not a bona fide quashing sought on behalf of the Petitioner. 5.
