The present petition is filed by the State challenging the order dated 21.04.2025, passed in Criminal Revision No. 92/2025, to the limited extent that although the learned Sessions Court has issued notice in the petition, however, the operation of the impugned order therein, being, order dated 17.04.2025, passed in Ct Case 1307/2024, has not been stayed. 4.

By order dated 17.04.2025, the learned Trial Court had directed registration of FIR against the erring police officials who were responsible for custodial torture of the respondent. Concededly, the matter has been fixed before the learned Court of Sessions on 29.07.2025.

At the outset, Mr. Bhandari, learned Additional Standing Counsel for the State submits that the since the order dated 17.04.2025 only relates to registration of FIR and the matter is now listed for arguments before the learned Sessions Court, he is not pressing the present petition at this stage. 7.

He, however, seeks liberty to file an appropriate application before the learned Sessions Court in case any action is taken by the complainant for compliance of order dated 17.04.2025.

Considering the above, the present petition is dismissed as withdrawn with liberty to the State to file an appropriate application before the learned Sessions Court at an appropriate stage.

Needless to say, the State is also at liberty to approach this Court by filing an appropriate petition if any grievance remains in future.
