O R D E R

The petitioner has filed the present petition seeking bail in connection with FIR bearing No. 391/2018 under Section 354/376/506 of the IPC registered with PS Nabi Karim, Delhi.

The said FIR was registered on a complaint of one "SS" (named concealed to avoid any ignominy). She had alleged that she was a teacher in the Government School and had met the petitioner on Facebook. They started talking to each other through chat and calls. It is SS's case that the petitioner had promised to marry her after completion of studies. However, she later became aware that he was already married and had a four year old son. Initially, she refused to talk to him but he kept calling her persistently. According to her, he promised that he would divorce his wife and marry her. She also alleged that she had met with the accused in a hotel, where they established physical relationship.

The petitioner has been in custody since 06.12.2018. The statement of the SS under Section 164 of the Cr.P.C. has been recorded and a

Chargesheet has been filed.

A Supplementary Chargesheet has also been filed and it is alleged that the petitioner had sent nude photographs of SS to his brother on his mobile phone. The petitioner alleged that the said photographs were sent by SS by an email.

Considering that the petitioner had been in custody for almost nine months, this Court considers it apposite to allow the present petition and release the petitioner on bail. It was also stated that the petitioner is a resident of Bokaro and was working as a Sales Manager in a Multi-National Pharmaceutical Company.

The petitioner is admitted to bail on furnishing a personal bond in the sum of ₹20,000/- and a surety of an equivalent amount to the satisfaction of the Trial Court. This is also subject to the following further conditions: (a) The petitioner shall not leave this Country without approval of the Trial Court.

(b) That the petitioner shall provide his current address and location to the concerned SHO, PS Nabi Karim. (c) He shall also provide his mobile number and ensure that he is reachable at all times.

(d) The petitioner shall be present before the Trial Court at all dates of hearing.

(e) The petitioner shall also not attempt to contact or influence, either directly or indirectly, any of the witnesses.

(f) He shall also refrain from attempting to contact with the prosecutrix.

Needless to state that if any of the conditions are violated, the bail granted to the petitioner shall be cancelled. 7.

The application is disposed of.
