under Article 226 of the Constitution of India read with Section 482 Cr.P.C. seeking quashing of FIR No.416/2023 dated 19.04.2023 under Sections 11/12 of Prevention of Cruelty to Animals Act, 1960 registered at PS: Bhalswa Dairy.
The Respondent has filed a status report dated 14.08.2024, which records that investigation revealed the Petitioner/accused is involved in preparation and supply of the chemical powder used in preparation of oxytocin solution, which is being illegally administered to milch animals. The FIR was registered by PS Bhalswa Dairy in pursuance to a raid conducted by the local Commissioner appointed by the High Court in a PIL pertaining to Prevention of Cruelty to Animals of Bhalswa Dairy. The status report records that Petitioner and other accused have been formally arrested and interrogated. It states that records of police station of Uttar Pradesh shows that the Petitioner herein has been involved in other FIRs as well.
Learned ASC states that the investigation is substantially complete, the charge-sheet shall soon be sent for legal scrutiny and thereafter be filed before the concerned Court in the next eight (8) weeks. Learned counsel for the Petitioner states that he has not received any instructions from the Petitioner in this matter. The matter is accordingly dismissed.
